Personal data policy

This Charter sets out in detail the SMCP Group ("SMCP") policy on personal data on its website www.smcp.com. In accordance with its global policy on personal data, SMCP makes every effort to respect users' concerns regarding the confidentiality of their personal data and information supplied to SMCP. In providing personal information and data, the user agrees to its collection, use and disclosure by SMCP under the terms set out in the Charter. The user agrees to SMCP using, analysing and, where appropriate, disclosing such personal information and data for purposes relating to user requests for documents, press releases and financial reports, or for recruitment purposes. We therefore invite users to read this policy statement carefully. This Personal Data Charter apples to all personal data supplied by the user on our website.

General information

Via its website, SMCP may collect personal data supplied by users, particularly in association with requests for documents, press releases and financial reports, or with applications for positions advertised through the website’s Talents section.

Any personal information the user may provide to SMCP for the use of certain services is subject to the provisions of the French data protection act (Loi Informatique & Liberté n° 78-17) of 6 January 1978.

Right of access, rectification, deletion and objection to processing

Users have a right to access, rectify and delete their personal information, and to object to the processing of such data, and may exercise this right at any time by writing to the following address:

SMCP’s management of personal data

Purposes of data collection

Via its website, SMCP manages and collects the user data strictly necessary for the following purposes:
– Sending out documents in response to requests/orders.
– Managing applications from users in response to job offers on the website.

The information (primarily last name, first name, address, user e-mail address) that we collect for these purposes, which is essential in order for us to respond to user requests, is indicated by an asterisk on the data collection form. If users do not complete these mandatory fields, we will be unable to respond to their request.

Data retention

Data is retained for no longer than is necessary for the purpose for which the data was collected:
– Requests for documents: data is retained only until the documents requested are sent to the user.
– Applications in response to job offers: we undertake to delete all the user’s data twelve months from the last update by the candidate.

Data recipient

SMCP is the data recipient.

A user replying to a job offer via the http://www.smcp.com/en/offers/ page, however, explicitly agrees to the use of their personal data by SMCP and/or an SMCP Group subsidiary concerned by the job offer in question, in order to assess the user’s application and, if necessary, make contact with the user. SMCP has put in place the necessary security and confidentiality to provide an adequate level of protection for user data, irrespective of the geographical location of the SMCP Group company receiving the data, either within the European Union or in any other country around the world. The user further acknowledges and accepts that SMCP may, in order to manage the user’s job application, transmit the personal data to external recruitment firms, which undertake to comply with the same requirements in terms of data security and protection.

Under no circumstances will SMCP transmit such personal data to a third party unless:
– The user has given prior approval for the sharing of such information.
– SMCP is obliged to share such information with third parties in order to provide the services requested by the user.
– SMCP is ordered by a legal or administrative authority to divulge the information to the authority.

For the purposes of technical management of personal data storage as part of our recruitment policy, the data will be held on the central servicers of our service provider, located in Ireland.

Data security and confidentiality

SMCP has taken all necessary precautions to protect the confidentiality and security of personal data processed and to protect such data against corruption, damage or access by unauthorised third parties.

State of the art technical and organisational security measures, particularly as regards information systems, have been put in place.

In order to access the Finance section, users are required to enter a personal password, as part of our confidentiality policy.

The company cannot, however, control all the risks relating to the Internet and how it operates, and draws the attention of users to the existence of such risks inherent in the use and functioning of the Internet.

Cookies and similar devices

Cookies are small text files saved to the device – computer, tablet, smartphone – used by the user to visit websites, including the websites of SMCP and its subsidiaries. Cookies enable us to identify the user visiting the site, to learn more about the user in order to offer an enhanced browsing experience, to ensure security while browsing, and to offer content tailored to the user’s centres of interest. When a user accesses our website, a cookie may be installed automatically and saved temporarily to memory or to the user’s hard disk, to make browsing easier.  A cookie cannot be used to identify a user, but is an element used to record browsing history on the site (pages visited by the user, data and time of visit, etc.), that we will able to read on future visits by the user to the site.

Users may refuse the installation of cookies by modifying the parameters of their web browser. This will disable all cookies used by the browser, however, including those use by other websites, which may result in the corruption or loss of certain settings or information.
